Xebba: Terms and Conditions of Service

These terms are subject to change and any such revisions will be published at the Xebba website. By registering for the service, users agree to be bound by these terms. These terms and conditions imply an agreement between Xebba and the user and may not be assigned or otherwise transferred to any other party.

Definitions of Terms

General Provisions

Xebba will endeavor to provide services without disruption, delay or distortion. However, due to the very nature of the internet, we cannot guarantee undisrupted availability of the services

Xebba may, from time to time, provide free calls, account credits, and other promotional or bonus activities. The activities will be subject to these terms and conditions and may be subject to additional terms and conditions associated with them. In such event, additional details will be provided via Xebba website.

Users must introduce funds into their accounts and must keep their accounts positively balanced in order to be able to use Xebba services.

Xebba will charge for all calls according to the schedule of rates listed on the Xebba website. The schedule is subject to change and may be adjusted from time-to-time at our discretion

Any use of any service provided by Xebba, its affiliates, or partners is always subject to the Acceptable Usage Policy currently in force and published on the website, or available by request from the Xebba customer service.

Xebba can provide telephone numbers to all users in order to receive calls from other telephone networks and operators. These numbers may be subject to an activation charge and any call rates as defined by the schedule of fees currently in effect. These numbers remain under the control of Xebba and cannot be retained by the user should the service be terminated. We reserve the right to change the number provided to the user at any time for technical reasons.

Xebba service does not include the facility to .port. or transfer-in or transfer-out telephone numbers for use with our service or any other.

Xebba reserves the right to terminate service reserves the right to terminate service to any user who it suspects may be in breach of the acceptable use policy.

Personal Information and Privacy

Xebba makes use of personal information which identifies the user of its services. This data is kept confidential and access to it is restricted to Xebba employees only and is not released to third parties except:

Xebba may, from time to time, send electronic or other communications to users of Xebba services using the personal information provided by that user or from information received from 3-rd parties or affiliates companies. Such communications are normally to advice of new service features, special offers, promotions, service information or in response to queries and/or to discuss other account issues such as rejected payments.

Xebba may analyze the calling patterns of users such that it can manage the capacity of its network and/or adjust pricing. It will not release such data to external/third parties except:

Regulatory Compliance

Xebba intends to fully comply with the Communications Assistance for Law Enforcement Act (CALEA) or any other applicable regulations. By using Xebba's services, you hereby agree and consent to Xebba's right to monitor, record, trace, and otherwise disclose the nature and content of your communications without notice to you.

Rates, Charging, Payments and Accounting

Calls are rated according to the destination and duration of that call and, in some instances, according to the date and time of day when the call was placed. All rates are available from the website and any changes will be reflected in the rates shown there.

Calls are rated in 5-second increments. I.e. Any transaction rated by duration will be rounded to the next multiple of 5 seconds and then the appropriate rate will be applied.

During any call, or other transaction, charges calculated will be deducted from the user's balance. In the event the user's balance is reduced to zero, the call will be terminated at that point.

Account balances are incremented using the website and are applied immediately after the payment transaction has been authorized by the issuing authority and the confirmation of such authorization is received.

Users must ensure that any credit balance on their account is positive. In the event the balance becomes negative, the following actions will take place:

Account balances and any charges posted to the account are not refundable. Under some circumstances, Xebba may credit users for erroneously posted charges. Any credit balances held on a users. account are non refundable, except where the user has terminated their use of Xebba service; where any credit balance will be refunded to the form of the original payment, subject to administrative charges in accordance with these terms and conditions. Refunds in a form of cash will not be made at any time.

In the event that a user believes that there have been incorrect charges, he/she should contact Xebba using the form provided on the website within 20 days of the event. Should an error be identified, Xebba will issue a credit in the form of a balance adjustment to user's account.

Inactive accounts

Accounts where no incoming calls are received for 12 months will be terminated and any credit left will not be refunded.

If you maintain more than one account and some of your accounts carry negative balance Xebba may transfer funds from your other accounts to cover that balance.

If a regular, direct debit or other payment is dishonored, blocked, or cancelled, Xebba may levy an administration fee against the associated user's account in the form of a debit to that user's balance to cover associated processing expenses.

Duration and Termination

These terms and conditions apply to any Xebba user from the point of registration. Users will continue to be bound by these terms and conditions until their use of the service is terminated according to the conditions within this section.

Users may terminate their accounts at any time with or without the notice. You may notify of your intent to discontinue the use of the service via the form provided on the website.

Users may add credit to their accounts at any time. User's accounts are not terminated on expiry of credit and users continue to be bound by terms and conditions until expired or terminated. Xebba reserves the right to terminate service to any user at its sole discretion where that user has breached, or in Xebba's opinion, attempted to breach the Acceptable Use Policy.

Xebba reserves the right to apply a fee of USD $5, plus any applicable taxes, to any residual balance to cover its administrative costs in closing the user's account.

Warranty and Liability

Xebba does not accept any liability for business or personal financial loss (including loss of profit, revenue, contract, expected savings, goodwill data or other financial loss) arising from the use, misuse or attempted use of its services. This includes any indirect or consequential loss which was not reasonably foreseen by Xebba at the time the user accepts these terms and conditions

Xebba will use its best endeavors to supply service but cannot guarantee availability of service in the event of any third party failing (including the user's own internet supplier), acts of God, severe weather conditions, power fluctuations or failures, act of terrorism or other civil disturbance, or government action.

Communications and support

Xebba provides support via its website at http://www.xebba.com. Support requests can be raised using the form on the website. The form generates a ticket with the staff at Xebba who will respond using email with assistance.

Miscellaneous

Xebba may vary these terms at any time by publication of the revisions to the website. Should a user not accept any revisions then they may terminate their use of service in accordance with these terms and conditions.

Should legal or regulatory conditions dictate, Xebba reserves the right to adjust the terms, conditions and/or actual services in order to meet requirements and/or regulations.

Any unenforceable, invalid or ineligible clause within these terms and conditions does not invalidate or otherwise make unenforceable or ineligible any other clause.

Xebba retains the rights and ownership to all components of the services designed, deployed and delivered to any user.
